A VICTORIA Falls man, who shocked the courts at the onset of his trial by claiming that he ejaculated on a minor because she walked in on him while he was masturbating, will pay a $400 fine. The 38-year-old man was last month dragged to court on allegations of raping a 15-year-old fellow tenant. Regional magistrate for the Western Region Mrs Dambudzo Malunga found him guilty of indecent assault after the State failed to prove that the minor was raped.
She slapped him with a $400 fine (or four months imprisonment).

“Your worship, I didn’t have sexual intercourse with complainant whether consensual or otherwise. She entered the bathroom where I was masturbating and I grabbed her inappropriately, in the process ejaculating on her skirt,” said the accused through his lawyer Mr Givemore Muvhiringi.

State prosecutor Mr Tawanda Sigauke alleged that on 28 November last year at around 10am, the teen was in the bathroom when the accused locked the main door.

When she finished bathing, she discovered that the main door was locked before the accused appeared from his room stark naked. He grabbed her and pulled her to his room where he pushed her onto the bed before raping her once. The court heard that the teen’s screams for help were of no use as the accused continued to rape the young girl.

After the act, it is further alleged that he went on to dress while the girl watched and she told him that she was going to tell her mother but he remained quiet before leaving the room.

The minor took a bath and washed the clothes she was wearing before going to her mother’s workplace where she reported the matter.
Her mother accompanied her to the police.
