Man fined for defaulting in maintenance payment

A 63-YEAR-OLD Bulawayo man has been fined $120 or two months in jail for defaulting in paying  $40 monthly maintenance for his former wife.
Kayisa Ncube, of House Number 61087 Pelandaba suburb, was on Tuesday convicted on his own plea of guilty to failure to comply with a maintenance order as defined in Section 24 of the Maintenance Act Chapter 5:09 by Bulawayo magistrate, Ms Sibongile Msipa.

The prosecutor, Mr Masimba Saruwaka, said on 6 July last year, Ncube was ordered by the court to pay his former wife, Mrs Musa Ncube $40 a month for her upkeep.

The court was told that as from March this year, Ncube defaulted in paying maintenance resulting in the arrears accruing to $120.

The court was told that Mrs Ncube then tried to negotiate with her former husband so that they could arrange and come up with a payment plan as he was struggling to raise the money.

Ncube refused, prompting the woman to report the matter to the police leading to his arrest.
