A BULAWAYO man got away with 420 hours community service sentence for causing the death of a Emakhandeni man whom he assaulted in a beer brawl.Zecharia Dondo from Emakhandeni allegedly assaulted Mark Moyo after he tried to drink his beer at MaHadebe Beer Garden on May 24 last year.
High Court judge Justice Lawrence Kamocha yesterday said Dondo would serve his sentence at Emakhandeni Day Care.
“You are sentenced to 18 months in prison of which six months are suspended for five years on condition you do not commit a similar crime. The remaining 12 months are suspended on condition you perform 420 hours of community service at Emakhandeni Day Care Centre,” said justice Kamocha.
The State case led by Sifiso Ndlovu is that Moyo met Dondo at the beer garden and they both drank beer separately.
Dondo then went to the off-sale section and sat on the counter. Moyo entered and found Dondo seated on the counter and tried to drink his beer.
A quarrel erupted and eventually the two fought. During the fight, Dondo kicked Moyo on the groin and stomach several times.
In retaliation Moyo head-butted him causing him to suffer a cut on the lips.
The cashier, Nancy Ncube who was seated outside, ordered the two to argue outside and Moyo went out and made an assault report at Luveve Police Station.
He went to hospital and was treated and discharged but later died at his house a few days later. A postmortem report read in court shows he died due to renal failure, ruptured bladder and assault.
