A MAN from Bulawayo pleaded with the court to dismiss a maintenance order for his two children, who are now married.
Jabulani Ndlovu on Friday told magistrate Manasa Musiiwa that he needed the court to relieve him of paying $400 maintenance for his children aged 25 and 21.
His wife, Sthabile Ndlovu, refused to respond to the questions posed to her by the magistrate saying she has a lawyer representing her on the matter.
“Your worship I engaged a lawyer in this matter. However, she said she has other commitments and is asking for the matter to be postponed to June 2016. As such I’m not liable to answer any questions as long as she isn’t here,” said Sthabile.
“My children are grown up now. My son has two children and my daughter has three”
Magistrate Musiiwa asked Ndlovu to proceed with the matter.
Ndlovu argued that his children had grown beyond maintenance age and had started their own families.
“My children are grown up now. My son has two children and my daughter has three. She’s currently staying with her husband although they’re not legally married. The only money I can pay is $150 for my youngest son,” he said.
Magistrate Musiiwa ruled that maintenance for the two older children be dismissed.
“The application of dismissal of maintenance is granted. The applicant will pay $100 for the upkeep of one minor child,” said Musiiwa.
