Marijuana and a gavel together for many legal concepts on the drug.

A MAN from Mashala in Hwange will rue the day he got high after smoking dagga after he was slapped with a 12-month jail term for touching a female villager’s private parts after she chastised him for his unruly behaviour.

Roger Munsaka (25) was last week convicted on his own plea of guilty by Hwange provincial magistrate, Mrs Portia Mhlanga. He was, however, spared jail after his sentence was reduced to community service.

Munsaka who was charged with unlawful possession of dagga and indecent assault blamed dagga for his action.

“Your Worship, I apologise for my actions, I wasn’t totally myself when I committed the offence. It caught me off guard as I was high from smoking,” pleaded Munsaka.

He was cautioned and discharged on the first count of illegal possession of dagga. However, the indecent assault charge attracted a 12-month prison term of which three months were conditionally suspended while the remaining nine months were converted into 350 hours of community service.

It is the State case that on 5 February 2018 Munsaka who had smoked dagga was insulting people at Mashala Business Centre when he was approached by a woman (name withheld) and asked to stop. However, this did not go down well with Munsaka who turned on her and begun to hurl insults at her before touching her private parts without her consent. Mr Onias Nyathi appeared for the State.
