A MAN who borrowed US$100 from his neighbour and failed to repay has been warned against abusing the courts after he tried to dodge settling a debt by obtaining a peace order against the woman who gave him a loan.
Sarikai Dipura borrowed the US$100 from his neighbour, Edina Chipunza, about two months ago and has not settled it.
Dipura approached the Harare Civil Court last week claiming that Chipunza was harassing him and threatening to bewitch him.
However, in her ruling, Harare magistrate Johanna Mukwesha, issued a stern warning to Dipura saying he must not take the law into his own hands and use it to evade paying off his debts.
“This is a court of law, you must not take us for granted, pay up your debt.
“If he can’t pay his debt there is a way to recover the money, approach the small claims court,” ruled Magistrate Mukwesha.
Edina told the court that she only wanted her money back and will seek the court’s guidance to recover it.
“We had agreed that he was going to repay me on April 2 but he has failed to do so.
“All I want is my money back and I am not worried about his application for a peace order. He must bring back my money,” said Edina.
The court found that Dipura could not be trusted and his testimony was inconsistent.
“I admit, I failed to repay her back on time but she has been threatening to bewitch me and cursing me each time we meet.
“It’s disturbing my mental health and I am afraid she will harm me,” said Dipura.
