THE trial involving Dynamos board chairman, Bernard Marriot, was postponed to next year pending an application at the Constitutional Court.
Marriot appeared before Harare magistrate Kudzai Hove who deferred the matter to January 26 next year.
Marriot, through his lawyer Advocate Tawanda Zhuwarara, told the court that they approached the superior court because his right to fair hearing was being violated.
This was after the Magistrates Court ordered his lawyer, Herbert Mutasa, to stop representing him citing conflict of interest.
In the application, Marriot said he has a long-lasting relationship with Mutasa, and wants him to represent him during the trial.
He argued that although Advocate Zhuwarara was a fine lawyer, he preferred Mutasa.
Mutasa stopped representing Marriot after the State, led by Tapuwanashe Zvidzai, successfully applied for his recusal from representing Marriot.
Marriot claimed that he tendered a board resolution of Dynamos FC (Pvt) Ltd which showed the absence of any conflict of interest.
Marriot is facing fraud charges involving Dynamos shares.
H-Metro is reliably informed that there are talks between the complainant and Marriot, which could result in an out of court settlement.
