Matombo issues summons

summons at the High Court seeking to nullify the election of the new executive at the recently ended congress.
Mr Matombo who was President in the previous executive, claims the August 19 to 20 2011 Bulawayo congress was null and void since it was never sanctioned by ZCTU and by himself as president.
He also argues that it was in violation of the ZCTU Constitution.
Harare lawyer Mr Lawman Chimuriwo of Gonese, Jessie Majome and Company is acting for the Matombo faction.
The new executive consists of Mr George Nkiwane as the president, Mr Japhet Moyo as secretary-general and three vice presidents – Ms Lucia Matibenga, Mr Rwatipedza Chigwagwa and Ms Sithokozile Siwela.
According to the plaintiffs’ declaration, the general congress held in Bulawayo was unlawfully convened and that the election thereof was also a nullity. Meanwhile Mr Matombo has issued a statement saying the true and legitimate ZCTU congress will be held on December 31 this year.
Mr Matombo said ZCTU had resolved to “authorise the president and general council to institute and defend any court proceedings, applications or actions.
“A resolution is therefore made mandating the president with such powers as bestowed upon him in terms of the Constitution”.
According to the statement, the resolution was made following a meeting held on Saturday by 94 delegates general council members, general secretaries and secretary-generals from the ZCTU and its affiliates.
