MDC-T supporter appears in court on violence charges

It is alleged Theophilous Moyo (29) from Epworth and his brothers Wisdom and Chiratidzo, who are still at large, accused Paradzai and Tonderai Madzivanzira of having participated in burning down their house during the Presidential run-off in 2008.

According to the State, Paradzai and Tonderai are admitted to hospital due to the injuries they sustained.
Moyo appeared before magistrate Mr Donald Ndirowei who granted him US$100 bail.
He was remanded to April 19 for trial.
Prosecutor Mr Tungamirai Chakurira had opposed bail arguing that Moyo committed a very serious offence.

“The offence was committed at an unfortunate time where it is everyone’s desire that peace prevails in our country,” said Mr Chakurira.
“This offence is purportedly a revenge to what happened to the accused in 2008 and has been waiting for elections time to revenge. It is therefore the court’s duty to protect the society from persons like him who have the habit of becoming the law unto themselves.”

Moyo’s lawyer Mr Kudzayi Kadzere of Kadzere, Hungwe and Mandevere Legal Practitioners argued that his client was a good candidate for bail.
The defence dismissed the State’s argument that the complainants were in hospital.
“State failed to show proof to such effect therefore my client cannot be denied bail on the basis of speculation,” said Mr Kadzere.

“This is a politically motivated offence since the accused is an MDC-T supporter while the complainants are Zanu-PF supporters.”
The State alleges that on March 10 this year, Moyo and his brothers went to the Madzivanzira’s homestead armed with iron bars.

They allegedly attacked Paradzai and Tonderai accusing them of burning their house during the Presidential run-off in 2008.
The two reported the case to the police leading to the arrest of Moyo.
