adminA Kadoma man, who stabbed his work-mate to death in a dispute over a debt, was on Tuesday jailed 12 years by the High Court.
Justice Felistus Chatukuta jailed Ishmael Mbizvo after finding him guilty of murder with constructive intent.
Mbizvo and the late Isaac Sengere were work mates at Bluegrass Mine in Kadoma.
Mbizvo owed Sengere ZW$20 billion and an altercation ensued when the latter demanded his money back.
The misunderstanding degenerated into a fight and Mbizvo picked up a knife and stabbed Sengere.
Justice Chatukuta said Mbizvo exceeded the limits of self defence and could have avoided the murder.
“We are of the view that the accused person, although he was under attack, he exceeded the bounds of self defence. The accused therefore failed to satisfy the requirements of self defence, as provided in section 253 of the Code,” said Justice Chatukuta.
The incident occurred on June 28, 2008, in the evening when Sengere went to Mbizvo’s house where he demanded his money.
Mbizvo, who did not have the money, turned violent and a fight erupted.
At the height of the fight, Mbizvo picked a knife and stabbed Sengere just under his left ear.
He was rushed to hospital where he died on admission. A post-mortem was conducted and a doctor compiled a report linking the stabbing to the death of Sengere. – CR.
