The victim, James Mudyarima, died at his homestead on October 6, 2023 after succumbing to multiple skull fractures.

On the day in question, Misheck, Beaton and their brother Wellington were in the company of Mudyarima drinking beer.

Micheck, Wellington and Mudyarima started a fight over an illicit brew.

Misheck was overpowered and left around 4pm.

At around 9pm on the same day, Misheck and Beaton picked another fight with Mudyarima at his homestead.

They attacked him with stones.

During trial, Beaton denied killing his neighbour, but admitted being at the scene when the initial altercation ensued.

He told the court that he later joined the fight at Mudyarima’s homestead.
