HIGH Court Judge Justice Esther Muremba has jailed a gold miner at Mukaradzi in Mt Darwin for 10 years after finding him guilty of assaulting to death another man on accusations of stealing his electric cable.
Justice Muremba initially sentenced Great Chinembiri to 13 years imprisonment before setting aside three years of the term for five years on the condition that he does not commit a similar offence within that period.
Chinembiri was being charged with murder.
He initially pleaded to culpable homicide, but was convicted of murder after a full trial.
It was the State’s case that on November 20, 2022, Chinembiri was told that Hillary Bhenge had stolen his electric cable.
Chinembiri then teamed up with Boyka and went to Bhenge’s place of residence.
Bhenge attempted to run away but was apprehended by a group of people.
Chinembiri, Boyka and the mob assaulted Bhenge indiscriminately all over his body.
The assault led to Bhenge confessing that, indeed, he had stolen the cable and sold it to Brighton Kamunhenga.
Chinembiri and Boyka then force-marched Bhenge to Kamhunenga’s place and along the way, they met another person, who joined in the assault.
Kamunhenga denied ever buying an electric cable from Bhenge, which infuriated Chinembiri, who ordered his victim to lie on his stomach and they used sticks to assault him on the back.
