THE National Social Security Authority (NSSA) has taken Foundation College to court for failing to settle a debt of more than $120,000 in contributions accrued over an unspecified period. NSSA this week filed summons at the Bulawayo High Court seeking an order compelling Foundation College to pay $120,670,28. The social security insurer through its lawyers T Hara and Partners said the college is a registered employer of labour obliged to pay monthly contributions in terms of Statutory Instruments 68 of 1990 and 393 of 1993.
“The defendant has a legal obligation to pay monthly contributions before the 10th of every month in terms of SI 393 of 1993. As at the last date of inspection, the defendants have accrued arrears in the sum of $120 670,28,” said NSSA in its summons.
NSSA said the failure by Foundation College to remit the contributions was a breach of their statutory obligation.
In the papers before the court, the social security insurer is demanding that the college pays the debt with a five percent interest per annum and cost of suit at attorney-client scale.
Foundation College has not yet filed notice of appearance to defend the summons.
Recently, NSSA filed another lawsuit against three Bulawayo engineering firms for failing to settle more than $80,000 in contributions.
