Outrageous maintenance claim

A MUTARE woman dragged her husband to Mutare Civil Court claiming US$2 000 for the maintenance of two minor children.

However, her outrageous demands were shot down by Mutare magistrate, Mr Xavier Chipato, who only awarded her US$50.

Ednah Muzerengwa appeared before the court, applying for US$2 000 for the upkeep of her two minor children.

The first child is aged six and the other is aged two.

 

She sired the children with Samson Mucharekwa who said he cannot afford such an amount.

Muzerengwa told the court that she separated with Mucharekwa and now stays with the two children alone.

She claims that Mucharekwa is a estate agent who realises US$6 000 a month.

Mucharekwa said he never mentioned such a figure as his earnings to Muzerengwa when they were still staying together.

He said at times he goes for three months without being paid.

Muzerengwa said she is a vendor and realises US$40 every month.

When asked by Mr Chipato to justify the US$2 000 maintenance claim, she said wanted US$460 for groceries, US$150 for rentals, US$80 for water, US$150 for medicals in case the children fall sick, US$40 as transport to and from school for both children and US$100 for the children’s clothes and uniforms. Her claims added up to US$980.

When asked what she wanted to do with the remaining US$1 020 from her budget, she said she wanted to use it to buy new property which was taken by her husband when they separated.

Among the property are blankets, plates and pots.

 

She went further and said her husband left her with nothing, hence she wanted to replace her property with the remaining amount.

Mucharekwa said they had a misunderstanding with Muzerengwa over the welfare of his little sister who suffers from mental health he was taking care of.

Mucharekwa said Muzerengwa was also lying about the kids going to school as the first one is waiting to be enrolled for Grade One, while the other one is still to be enrolled in Early Child Development classes.

Mucharekwa offered to give her the sum of US$50 and take care of all school related things.

Mucharekwa also said he still loves Muzerengwa and wants to visit her parents so that they can find an amicable solution to their misunderstanding for her to come back and continue to be his wife.
