ONLY one of the four Foundation College pupils who were arrested for allegedly killing a man from Nkulumane suburb in Bulawayo has been formally charged with murder.

Zangelozakwethu Thebe, 20, a Form Six pupil, allegedly struck Vengai Clayton Muza with a brick leading to his death.

Thebe was arrested with three friends from the same school for the deadly assault but police investigations have since established he was the one who struck the fatal blow with a brick.

Thebe appeared before Bulawayo magistrate Tinashe Tashaya who granted him bail pending trial.

His lawyer, Shepherd Chamunorwa from Calderwood, Bryce Hendrie and Partners, pleaded with the court to grant him bail as Thebe is set to write his final public examinations in two weeks.

“I believe my client is a good candidate for bail as he has no previous convictions and is unlikely to interfere with State witnesses. I understand that the investigating officer has finished investigations and we are sure that he will be eventually charged with culpable homicide or assault,” said Chamunorwa.

He added: “There is evidence that the accused, the deceased and others were involved in a fight which led to the unfortunate loss of life.”

Magistrate Tashaya granted the bail application and barred Thebe from visiting Nkulumane suburb until the matter was completed.

“You will deposit $100 for bail and come back to this court on October 30,” said magistrate Tashaya.

Taurai Hondoyemoto prosecuting said the incident happened on October 10 at around 11PM along Rangemore Road near Mtshane Primary School in Nkulumane.

“Thebe was in the company of two others coming from a graduation party when they came across Muza who was also in company of two friends.

When they crossed paths, the two parties bumped into each other resulting in a fight between Thebe and Muza,” said Hondoyemoto.

He said during the fight Thebe picked up a brick.

“He struck Muza on the forehead and he fell to the ground in the middle of the tarred road. Thebe fled from the scene and Muza was found dead and his body was taken for post mortem. “

Hondoyemoto said the post mortem results show that he died due to cerebral damage, depressed skull fracture and severe head trauma due to the beating.
