AN HIV-positive father, who raped his daughter while he was drunk from an illicit brew called “King Stallion,” has been convicted.
Magistrate Donald Ndirowei lamented over how illicit brews have turned people into “animals”.
“It is literally killing people. The cheap, but lethal brews distilled in backyard breweries, are turning people into animals if this case, where a father raped his biological daughter in the most gruesome fashion, is anything to go by.
“The accused then blamed drunkenness for his unforgivable acts, he said he had spent the whole day drinking an illicit type of alcohol called “King Stallion”.
Prosecutor Shambadzeni Fungura proved that the daughter was staying with her aunt in Epworth and, on March 2, the father went to visit them. He advised his sister that he had decided to take his daughter back home.
They left Epworth for Mbare and, when they arrived, he grabbed her and fondled her breasts.
He then told her that he wanted to have sexual intercourse with her.
The complainant rejected her father’s advances.
The father took her took her to Msasa where he started to drink “King Stallion.”
At around 8 pm, somewhere near Athlone Park, he raped her.
The girl and the maid testified in court and prosecutor Fungura produced the medical affidavit which proved that she had indeed been raped.
During the victim-based assessment, the daughter told the court that she once decided to commit suicide as she was worried that she may have been infected with HIV.
“The reason why I recorded everything that transpired was because I was afraid that no one was going to believe me, even when I first told them no one believed me until I produced the audio.
“He must be jailed for life because he might abuse me again or my little sister.”
Prosecutor Fungura applied to have the father tested again as this fact arose in the victim assessment process and was confirmed by his wife.
The matter resumes today.
