accomplices of armed robbery kingpin, Godknows Machingura, have suffered a major setback after the magistrate dismissed their application seeking further particulars.
Magistrate Taurai Manuwere ruled that particulars being sought should be relevant to the charge and the documents they were requesting were not relevant.
He said the lawyer, Joseph Nemaise, used the wrong charge and that while the documents being sought are under the custody of State institutions, they were not going to be used and the gang was not entitled to the papers.
Machingura’s accomplices — Paul Enerst Mazenge Zhou (55) and South African nationals — Ndiafhi Makhado (39), Andrew Masubelele (38) and Emmanuel Makamo (22) — notified that they will be making an application for referral to the Constitutional Court.
The quartet was arrested after the police got a tip-off that they were planning to rob businessman Paul Chimbodza.
The police raided a guest house that they had booked and a shoot-out occurred.
Machingura was shot dead.
Zhou allegedly confessed to the detectives and the suspects revealed to the detectives that they had hatched a plan to commit a robbery along Birmingham Road, Kwekwe.
Acting district public prosecutor, Tafara Chirambira, appeared for the State.
