Robbers to share 17-year sentence

Khumalo was sentenced to eight years imprisonment of which two years were suspended on condition of good behaviour.
A further one year was suspended on condition that he restitutes Mr Foya US$532 by November 30 this year.
Samson was imprisoned for nine years, of which one year was set aside on condition he restitutes Mr Foya US$532 by the same date.
Khumalo is Mr Foya’s cousin brother.
In passing the sentence Harare magistrate Ms Esthere Chivasa said a custodial sentence was proper under the circumstances.
“Khumalo’s moral blameworthiness is very high in that he masterminded and co-ordinated the robbery and stole from a brother,” said Ms Chivasa.
“He has to serve a jail term although he was not present during the robbery.
“Samson has become absolutely incorrigible and addicted to prison life.”
Prosecutor Mr Daniel Muchimbiri proved that Mr Foya owns MKD Shop at Gulf Complex and Blue Line Tuckshop at Mverechena Shopping Centre in Domboshava.
On August 27 this year, Khumalo went to Mr Foya’s shop with one Mike Changa, who is still at large.
They waited until Mr Foya collected his daily takings and accompanied him to his house on the pretext that he wanted to see his sick son.
He then alerted Samson and his other accomplices to the fact that Mr Foya was at his house and would be leaving to visit his second wife.
They then attacked and handcuffed Mr Foya before ransacking the house and stole US$1 500 and three cellphones.
The gang took Mr Foya to a stream between Kuwadzana Extension and Snake Park where they threatened him with a pistol demanding more money.
They assaulted Mr Foya with sticks before removing the handcuffs and left. Mr Foya filed a police report the following morning leading to the arrests.
Police arrested Khumalo, who in turn led them to Foya at Munyuki Shopping Centre in Epworth.
