Rogue tout strikes kombi driver

AN unrepentant Hob-house tout who always appears in court for the wrong reasons, attacked a kombi driver with a metal object and fists over clients. Fidelis Mukombe was convicted on his own plea of guilty when he appeared before Mutare magistrate, Mr Langton Mukwengi. He was facing the charges of contravening Section 131 of the Criminal Law (Codification and Reform) Act.

He was ordered to pay $60 fine.

Prosecuting, Ms Christine Mwenga said on October 10 at around 12-midday, Mukombe struck Gibson Mutembedza on the forehead with a metal object. He also attacked him with fists resulting in Matembedza collapsing. The court heard that Mutembedza was driving his kombi along Magamba Road en-route to the CBD, while Mukombe was in another kombi touting for passengers.

Mutembedza was driving behind the kombi in which Mukombe was in. He reversed his kombi to pick some passengers. The driver of the kombi in which Mukombe was in had also reversed to pick up the same passengers. “The two had a misunderstanding after the passengers they had reversed for opted to board Mutembedza’s kombi. Mukombe assaulted him with fists and later attacked him with a metal object. Mutembedza collapsed after the attack.

“He sustained deep injuries on his forehead and had a swollen face,” said Ms Mwenga. Asked why he had committed the offence, Mukombe pleaded with the court for leniency saying what he did was wrong. “Please forgive me Your Worship, I erred, but he also provoked me by picking passengers we were supposed to pick,” said Mukombe.
