Aggrieved by the dismissal, Fadzai appealed to the Labour Court arguing that the chairperson of the Works Council was impartial and there was no evidence to sustain his conviction. There was a document alleged to have been signed by Ngoni Nyambuya from Food World.
During the disciplinary hearing, Nyambuya was made to sign five times so as to find out whether he was the one who signed the delivery note or not. The committee found that the handwriting was not the same with the one on the delivery note.
The signed documents were sent to a handwriting expert who found no evidence to indicate that Nyambuya authored the questioned document.
Labour Court president Ms Betty Chidziva noted that there was ample evidence to prove that the soft drinks never reached Food World.
Said Ms Chidziva: “Ngoni Nyambuya never signed for the drinks. In the circumstances therefore the only reasonable conclusion that the court can make is that the soft drink were stolen and they never reached Food World.”
Ms Chidziva said the issue of bias by the Works Council did not stand. Furthermore, Fadzai never substantiated the allegation of bias. Ms Chidziva dismissed Fadzai’s appeal with costs.
