Unitime Investments and Release Power Investments are battling for the control of the property and hundreds of students have always been left stranded when schools open.
It has emerged that at the time when Unitime Investments bought the land in question from Assetfin, the lawyer, Vote Muza, now representing Release Power was employed in the law firm appointed by Assetfin.
Unitime, through its directors, has shown that there is possible conflict of interest as they were paymasters to him.
The company (Unitime) has also complained in a criminal case (CR 488/7/2010) against Mrs Elizabeth Mawire of the deeds office for issuing a second title deed to Release Power on the same property.
It is alleged at the time when Mrs Mawire issued the second deed, deduction from the main deed was already in place.
It is also alleged the deed by Release Power Investments was done by Mr Oniyas Gumbo without a lawful power of attorney and the property, measuring over 53000 square metres, was obtained (by Release Power) for “only” ZW $4 000 dollars.
“It shows that there was no lawful board resolution empowering Gumbo to transfer this property to his own company when he knew that the property belonged to Unitime Investments.
“He (Gumbo) had in an earlier letter written to the bank, authorizing the transfer of the property to Unitime Investments,” said Unitime in papers yesterday.
Unitime added: “The docket and letter to the AG questions the logic of Gumbo in that he gave a resolution to the effect that the land should be transferred to Unitime and in yet to be explained circumstances, take the same land and transfer it to his own company.”
The Public Service Commission has also been asked to comment on the behaviour of Mrs Mawire as she is accused of possible complicity in fraud together with Gumbo.
Ms Elizabeth Mawire, who works at the Deeds Registry was fingered in attempting to issue a second title deed to Release Power and a case No CR 488/7/2010 was reported at ZRP Serious Frauds.
Unitime Investments has declared that they own the property as per Title Deed Number 3410/2009.
Release Power Investments also owns the same property through Title deed Number 4873/2009 produced six months later while a letter from the Chief Registrar of deeds acknowledges there are two title deeds to the property.
