The wife of a man who hasna��t had sex for a year added more misery to his life when she reported him for physical abuse as defined in Section 3 (1) (a) of the Domestic Violence Act Chapter 5:16.
Gregory Gomez (48) is not a happy man and now has legal troubles too.
a�?Your worship, it has been over a year since my wife chucked me out of our matrimonial bedroom. I now sleep in a spare bedroom and sometimes in the sitting room while she will be enjoying the comfort of our bedroom bed alone.
This is the reason I thought enough was enough due to my frustrations as a man,a�? he said when he appeared before Bulawayo magistrate Tinashe Tashaya.
But he said he didna��t lay a hand on his wife Leigh Gomez (48) but just made her feel what he felt.
a�?But I didna��t assault her, I only dragged her out on the floor as I wanted her to feel how it is to sleep outside the bedrooma�?, said the teary Gregory.
Circumstances as presented by the prosecutor Mr Taurai Hondoyemoto are that on 5 November at around 7pm the accused person went home in a drunken stupor and found the complainant lying on the bed in the main bedroom.
a�?Gregory started accusing the complainant of having extra marital affairs and told her to move out of the house and find somewhere to stay since she no longer wanted to sleep with him,a�? Hondoyemoto said.
The court further heard that the complainant and the accused started exchanging harsh words until the accused person assaulted and dragged the complainant on the floor using both hands.
As a result of the assault the complainant was referred to United Bulawayo Hospitals for medical examination leading to Gregorya��s arrest.
For the offence Gregory who pleaded guilty to the charge was sentenced to three months imprisonment wholly suspended for three years on condition that the accused person does not commit a similar offence within that period.
