A SOLDIER based at 4.1 Brigade Barracks in Masvingo savagely assaulted his junior and knocked out two of his front teeth after finding him having a drink with his wife.
Appearing before Masvingo magistrate Takawira Mugabe on Thursday, Brighton Tendaimambo (32), a captain residing at 4.1 Brigade Barracks marriage quarters pleaded guilty to assaulting Abel Chiocha (40) of the same address.
In his defence, Tendaimambo told the court he did not regret brutally bashing his subordinate a�� whose rank was not mentioned in court a�� because he had dealt him the ultimate insult by sleeping with his wife, in his bed and house.
He unleashed kung-fu kicks, a series of punches and a headbutt that sent two teeth flying out of the hapless Chiochaa��s mouth.
Mugabe convicted Tendaimambo on one count of assault and fined him $250 or three months in prison.
He was given up to May 31, 2018 to pay the fine.
The magistrate slapped him with another three months imprisonment which he wholly suspended, for five years, on condition of good behaviour.
Tendaimambo said he was incensed by Chiocha after catching him having quality time with his wife at his house.
Chiocha denied being caught pants down with his superiora��s wife.
He said Tendaimambo only found him having drinks with the woman.
a�?Your honour, I found the two being intimate in my bed and I reacted accordingly. Chiochaa��s behaviour was so demeaning that I lost my cool and gave him a hiding.
a�?I do not regret what I did because he belittled me by engaging in an extra-marital affair with my wife. He disrespected my matrimonial bedroom for that matter and he is lying that I found him, only talking to my wife, outside,a�? said Tendaimambo.
Agreed facts were that on December 19 last year at around 8pm, Chiocha proceeded to Tendaimamboa��s residence within the barracks to collect a packet of meat which he had given to his superiora��s wife for refrigeration.
The court heard that Tendaimambo suddenly arrived home and saw Chiocha having a drink with his wife and this did not go down well with him.
a�?Tendaimambo slapped Chiocha several times on the face, hit him all over the body with fists and forcibly pushed him against the wall.
a�?He also head-butted him on the mouth and the complainant lost two of his front teeth as a result,a�? said Mr Fidelicy Nyamukondiwa, prosecuting.
Mr Nyamukondiwa said Chiocha fled and made a formal report at Masvingo Central Police Station leading to Tendaimamboa��s arrest. A medical report was available in court as exhibit.Walter Mswazie
