Space Telnet (Pvt) Ltd through its Head of Business Development Retired Colonel Richard Kuhuni is challenging the awarding of the tender to Frolgate Technology (Pvt) Ltd citing some irregularities. Frolgate (Pvt) Ltd was awarded tender for the supply of Cisco 3750 switches. The State Procurement Board, Powertel (Pvt) Ltd and Frolgate Technology (Pvt) Ltd are listed as respondents in the matter. Mr Tazorora Musarurwa of Mambosasa Legal Practitioners is representing Space Telnet (Pvt) Ltd.
“The decision of the first respondent was irrational and or biased in that it awarded the tender to the third respondent notwithstanding the fact that the appellant met all the specifications and had a far much lower cost of US$532, 818.00 than the third respondent who bid for US$904, 488.97 or any other bidder,” said Mr Musarurwa.
“The decision of the first respondent was irrational and or biased in that in adjudicating the tender the first respondent in connivance with second respondent added a new requirement that bidders must prove that they are “smartcare” certified yet all that was required was for bidders to mention that they were Cisco certified distributors and that the equipment came with ‘smartcare’ support.”
Mr Mambosasa appealed for the tender to be withdrawn and awarded to Space Telnet (Pvt) Ltd. He also said SPB and Frolgate Technology (Pvt) Ltd were supposed to pay the legal costs.
