IN a bid to try and evade paying maintenance, a Mutare man revealed that he had eight other children who were all in secondary school. Nhamo Bangwaya told the court that out of his $430 monthly salary, he could only part with $40 for his two other minor children he fathered with Patience Mukwaya.
Mukwaya had approached the courts claiming $167 as monthly maintenance.
Magistrate Langton Mukwengi presided over the matter. In her breakdown, Mukwaya stated that she needed to use $40 for school fees and the rest for bills and food.
However, she did not deny the fact that Bangwana had eight other children.
“Of course I know that he has eight other children but he has to contribute to the upkeep of the children that he fathered with me. They also have the right to his earnings,” she prayed.
Bangwana told the court that he had the desire to contribute more to his children but $430 was not enough for 10 children.
“Your Worship, I have to pay school fees for all my 10 children and I pray that Mukwaya understands me and only apply for the fees and not anything else. That is all I can afford at this moment,” he begged the court.
Bangwana was ordered to pay $40 monthly to Mukwaya as maintenance for his two minor children.
