Supreme Court upholds cancellation of Serepta’s mining claim certificates

The Supreme Court has reaffirmed the cancellation of mining claim registration certificates held by Serepta Resources (Private) Limited, bringing finality to a long-standing legal dispute with Ariston Holdings (Private) Limited over land use at Kent Estates in Norton, Mashonaland West Province.

This ruling resolves issues related to Serepta’s plans to mine on Kent Estates, where it had registered 12 gold reef claims and started infrastructure development.

Last year, the High Court nullified Serepta’s mining claim certificates, citing non-compliance with legal requirements and ordered their immediate cancellation.

The court also directed Serepta and the Mining Commissioner for Mashonaland West Province to cover the costs of the legal proceedings.

Serepta challenged this decision by appealing to the Supreme Court, but the appeal was dismissed.

Justice Nicholas Mathonsi, delivering the Supreme Court’s ruling, upheld the High Court’s findings.
