Tanyanyiwa’s uncle acquitted

Mukurazita, who was represented by Mr Nathaniel Chigoro of James Makiya Legal Practitioners, was acquitted at the close of the State’s case by regional magistrate Mr Clever Tsikwa, who ruled that the State had failed to prove a case against him. Mr Tsikwa said the State ought to have proved that indeed Tanyanyiwa had committed a case of fraud before charging Mukurazita.

Prosecutor Mr Oliver Marwa alleged that Tanyanyiwa, well knowing that he had no money to buy a house, hatched a plan to defraud Chitungwiza municipality.

He looked for a house to buy, which cost US$165 000.

He allegedly misrepresented to Kingdom Bank Graniteside Branch that Chitungwiza municipality had authorised the transfer of US$80 000 from its account to Floburg Real Estate’s FBC account for the purpose of servicing Nyatsime stands.

He allegedly converted the money to his own use and to cover up for the offence, Tanyanyiwa allegedly connived with Mukurazita and wrote a letter that purported that Mukurazita’s company had been contracted by the Town Clerk to service Nyatsime stands. In the letter, the State alleged that Mukurazita stated that the Chitungwiza Municipality owed Nissam Investments US$80 000.
