A STUDENT teacher who failed to control his sexual desires and caressed a fellow passenger’s private parts in a commuter omnibus has been fined $100. Collins Mhise (35) was convicted of indecent assault by Mutare magistrate, Miss Nyasha Kuture. Mr Shepherd Chavarika prosecuted. It was the State’s case that Mhise fondled the 21-year-old complainant’s breasts and went on to caress her private parts as they were travelling from Hob-House to the City Centre along Magamba Road recently.
Said Mr Chavarika: “At Amtec Motors, the complainant lifted her handbag which was on her lap and found Mhise’s left hand between her thighs and caressing her private parts. This was after she had ordered him to remove his hand from her breasts earlier on.”
The complainant told the court that Mhise started caressing her in Hob-House, but she thought it was the bumpy ride which was causing her discomfort.
“I did not notice that his hand was on my private parts because the ride was bumpy. When I removed my bag I saw his hand between my thighs moving back and forth,” she said.
However, Mhise denied the allegations saying the complainant and her mother were framing him because he had caught them red-handed trying to steal his cell phone.
“Your Worship, my hand is not made of steel that somebody would not feel that she was being caressed all the way from Hob-house to town.
“The truth is that I caught the pair trying to steal my phone and the mother started shouting at me pulling me by my tie and the next thing I was in a police cell,” he defended himself.
