TOP businessman Tempter Tungwarara’s Prevail International Trust was duped of a property worth US$75 000 by an alleged habitual fraudster Tadious Marufu.
Marufu, who has similar cases pending, appeared before Harare magistrate Dennis Mangosi, who rolled over the matter to today for bail rulings. Allegations are that last year, Marufu connived with one Erick Dube who is still at large to dupe the trust, which is being represented by its property manager Golden Maisiri.
Pursuant to their plan, they obtained a fraudulent title deed for property number 825
Mandara Township, Harare owned by Elizabeth Khaka.
They went on to craft a fraudulent special power of attorney in Ryan Tichaona Murape’s name purporting that was given authority to sell the property by Elizabeth Khaka.
The State alleged that the two went on to craft an agreement of sale purporting as if Ryan.
Tichaona Murape had sold the property on behalf of Elizabeth Khaka to them.
Armed with the fake documents, the duo approached the trust and advised them of the property for sale for US$75,000.
On behalf of the trust, Maisiri agreed to the deal and an agreement of sale dated 24 July 2023 was compiled with Marufu as the seller and the trust as the buyer.
The trust paid a deposit of US$35 000 on the same date and the balance of US$40 000 was paid before 31 August 2023.
Maisiri was then advised by Marufu that change of ownership would be done simultaneously from Elizabeth Khaka to his name then to Prevail International Trust with the help of lawyers TK Hove and Partners.
The trust went on to make developments on the property and began constructing garden flats before they were approached by Elizabeth Khaka who advised them that she was the owner of the property they were developing.
The trust halted developments and went to make further verifications on the issue and discovered that the owner of the property was Elizabeth Khaka, not Marufu, and was never for sale.
They also discovered that the Power of Attorney presented to them by the duo was fraudulent and never authored by Elizabeth Khaka.
