adminRichard Kuengwa (33) of Unit P in Chitungwiza was convicted on his own plea when he appeared before magistrate Mr Adonia Masawi. Kuengwa was sentenced to six months in prison for negligent driving with three months of his sentence set aside for the next five years.
He was also sentenced to a wholly suspended five months jail term for driving without a licence. In addition, Mr Masawi banned him from driving any classes of vehicles for the next one year.
In aggravation, prosecutor Mr Lovet Muringwa noted that Kuengwa’s behavior was uncalled for since he failed to heed the call to desist from driving without a licence.
“The accused acted in a manner that is worrisome. Driving a public vehicle without a licence alone makes it a serious offence. He was endangering the lives of both the passengers and pedestrians,” said Mr Muringwa.
However, Mr Masawi highlighted that according to the State papers there was no evidence linking Kuengwa to have been driven a public transport since it was only written as a Toyota Hiace.
Circumstances were that on June 7, Kuengwa was driving a Toyota Hiace along an unknown road in Zengeza 4.
As he approached the bus terminus, he knocked down the minor who was crossing the road. She sustained bruises on the forehead and a fractured right arm. Mr Murinngwa proved that on the day, Kuengwa failed to keep proper look out and to keep the vehicle under proper control.
