Chairman acquitted

Chitungwiza magistrate Mr Kudakwashe Jarabini acquitted Moses Mutambo (43), of Unit M after the close of the State case.

In his ruling, Mr Jarabini noted that the State witnesses’ evidence was marred with inconsistencies.
“The State failed to prove its case beyond any reasonable doubt and the accused is found not guilty and acquitted,” said Mr Jarabini.

Circumstances were that on June 15 during MDC-T’s primary elections in Chitungwiza, Mutambo accused Precious Muganda (22) of forging names of people on the electoral college.

Muganda denied the allegations and an argument ensued, which resulted in Mutambo slapping her on the face.
During the melee, Mutambo was restrained by the party’s organising secretary Blessing Utete of the same ward.

In a fit of rage, it is alleged that Mutambo punched Utete, accusing him of being part of the team which tampered with the electoral college to bar his supporters from voting.
It is further alleged that Obert Matsika, an election agent of Onisimo Makururu, was also assaulted by Mutambo for restraining him from harassing fellow supporters.
Ms Ntombikayise Nleya prosecuted.
