adminAdmire Rubaya was not formally charged when he appeared before Harare magistrate Ms Anita Tshuma who remanded him out of custody to January 15 next year for trial.
Fuller was ordered to surrender his travel documents and report twice a week at Highlands Police Station.
The complainant in the matter is Pablo Zohar.
Prosecutor Mr Tungamirirai Chakurira alleges that sometime in May this year Fuller showed Zohar a gold milling machine at his premises and told him that he wanted to sell it and the complainant became interested.
It is alleged that the pair negotiated and agreed that the machine and other accessories including installation at the site in Shurugwi would cost US$80 000.
Zohar made payments in two instalments through money transfer with the first instalment being of US$22 000 and the other US$58 000.
Fuller, it is alleged, promised that he was going to fix and install the machine in six weeks.
After the six weeks lapsed Zohar went to check the machine and discovered that its owner had repossessed the machine he had been shown, it is alleged.
The State says Zohar realised that Fuller had misrepresented to him that the machine was up for sale.
As a result he was prejudiced of US$80 000 and nothing was recovered.
