A Mutare woman recently applied for a peace order against her ex-husband whom she accuses of stalking her and disturbing her peace.
The matter was heard at the Mutare Magistrates Civil Court by Mr Xavier Chipato.
Beatrice Muyambo said Raymond Madziyanike harasses her and follows her to her workplace to disturb her peace.
Muyambo told the court that she had been married to Madziyanike for twelve years and they separated three months ago as Madziyanike was in the habit of assaulting her with a matchet and an electric rope.
She also told the court that at one point, Madziyanike intended to kill her.
However, she managed to escape and has been staying at her parents’ home since then.
“I decided to leave him because he was in the habit of assaulting me using an electric rope and a matchet. He was threatening to kill me. He is now coming to my workplace to disturb my peace,” said Muyambo.
She went on to tell the court that she is no longer interested in Madziyanike as she is afraid of losing her life.
However, Madziyanike said he never assaulted Muyambo with an electric rope or a matchet.
He said he only slapped her once when she wanted to leave the house at midnight following their misunderstanding over his unwashed clothes.
“I only asked her why she had not washed my clothes.
Instead of answering my question, she tried to run away at midnight and that’s when I lost my temper and slapped her once.
The following morning she took all her belongings and went to her parents place,” said Madziyanike.
He went on to tell the court that while he was not opposed to Muyambo’s application for a peace order, he would be prejudiced as he won’t be able to have access to his two children.
Madziyanike told the court that he loves his wife, adding that is why he has been pursuing her so that they can work things out.
“I love my wife very much and there is no way I can assault someone that I love with a matchet and an electric rope. After all we do not have a matchet at our homestead, when we need a matchet to fetch firewood we usually get it from our neighbors,” said Madziyanike.
He went on to ask the court to help him reconcile with his wife.
However, the court said it could not give such orders to Muyambo.
The couple was advised to engage their families over the issue and to resolve the matter amicably.
Mr Chipato also granted the peace order in Muyambo’s favour.
Madziyanike was ordered not to assault, harass, and follow Muyambo at her parent’s home and work place for the purposes of disturbing her peace.
