A CHIKANGA woman arrived at the Mutare Civil Court scantily dressed after her husband allegedly threw her out of their matrimonial house moments after she had served him with court summons. Emily Malaba appeared before Mr Poterai Gwezhira claiming $250 maintenance from her negligent husband, Lesman Humbe whom she accused of being irresponsible.
She alleged that he was ignoring his family needs.
Malaba told the court that Humbe threw her out of their house after he received court summons.
“The day he received the court summons he threw me out of the house and said that I had to withdraw the case or risk being homeless. I had to sleep outside that day. I was not dressed properly when he threw me out.
“Your Worship even though we came together today he told me that if the order is to be granted I am no longer welcome at his house in Chikanga. I pray for the courts to intervene,” she said.
Humbe, however, dismissed her allegations saying he was a responsible father to both his children and wife. He went on to produce proof of Ecocash transcripts which showed the money he sent to his family monthly.
He also told the court that he had married another wife in Tsholotsho and therefore could not afford the $250 being claimed by his wife.
“Your Worship, I do send money for my family’s upkeep monthly and I wonder why she is labelling me irresponsible. I am also against her claim. Why does she need $100 for rentals when she stays at our stand in Chikanga 3? She should stop playing games because I bring my children clothes each time I visit from Tsholotsho,” he said.
Malaba told the court that she needed money for rentals because he had hinted on their way to court that she was no longer welcome at his house if the maintenance order was to be granted.
A $150 maintenance order was granted to Malaba and her two children.
