A HARARE woman left the Harare Civil Court in tears after her maintenance claim was dismissed.
Chipo Mutambutambu had dragged her former husband, Charles Chitsamba, to court demanding $166 000 for their three children aged 12, 10 and 5 years.
She told the court that she needed money for food, medical aid and transport.
“He is self employed as a welder and owns a company. He makes about US$500 per month. I am not sure if he remarried, but he used to cover all these expenses, and he suddenly stopped, and that’s why we are here today,” she said.
The case took another twist when Charles told the court that the children actually stay with him and he takes them to school every day.
“I am offering $100 000, but I am actually surprised that we are here. Why should l pay maintenance when I am the one staying with the kids since she has remarried?
“If the court permits, l would like some time alone with her to discuss matters concerning our kids.”
Chipo defended herself saying Charles actually came to cause confusion and disturb her peace when he found out that she had remarried.
“He threatens the kids that if they come to stay with me, he will stop paying their school fees or buying clothes for them.
“I stay with the younger child and the other two are with him, but l would like them to come back to me.”
Magistrate Ayanda Dhlamini dismissed the case.
“This is a case of custody which can be solved in another court and you can come back after all is settled,” said magistrate Dhlamini.
