Woman escapes jail term for US$400 theft

Constance Kazviyo (35) was last week convicted on her own plea of guilt to theft charges before Chitungwiza magistrate Mr Godfrey Unzemoyo, but she collapsed in court.

In sentencing Kazviyo, Mr Unzemoyo took into account that she was a single parent, therefore, sending her to prison would put her children’s life at stake.
He also noted that the two parties have agreed to an out of court settlement and she is also epileptic.
Prosecutor Ms Concellia Maheya told the court that Kazviyo was employed by Emec Company as a marketing officer.

In turn, she would get a 10 percent commission for every job she brought to the company.
She then secured a job for the company at Mabamba premises, which entitled her to the 10 percent.

On October 7 this year, she went to the complex to collect the cash as usual and decided to pocket it.
After that she terminated her contract on the basis that the money was to compensate her outstanding salaries without following the company’s regulations.

Last week she collapsed in the dock after the court denied her bail.

Court orderlies and prison officers had to apply first aid.
This prompted the magistrate to revoke his decision to deny her bail and remanded her out of custody on US$20 bail pending sentence.
