her daughter, was lucky to escape a jail term after she was given a wholly suspended sentence.
Tambudzai James’ child (age not given) hit Emily Fidis’ daughter with an iron bar after a dispute.
As a result, Emily tried to counsel Tambudzai’s child and she could not have any of it and an altercation ensued between the two.
Magistrate Mr Donald Ndirowei sentenced Tambudzai to a suspended 12 months prison term for five years on condition she does not commit a similar offence within that period.
Tambudzai had pleaded guilty to the assault charge arguing she had committed the offence out of anger.
She, however, pleaded for the court’s leniency. However, in aggravation prosecutor Ms Sarah Bosha had called for a stiffer penalty saying, “The attack was not due to provocation from the complainant but arose from the dispute between their two children.
“Instead of solving the matter amicably, accused resorted to violence thereby causing permanent injuries on the complainant.
“The sentence should be one which discourages people from taking the law into their own hands.
The court heard that on September 7 this year after the misunderstanding between Emily and Tambudzai’s daughter, Emily went away and later came back around 7pm.
Upon seeing Emily, Tambudzai went into her house and boiled some cooking oil, which she later poured on the unsuspecting Emily.
She sustained serious burns on her back.
She was taken to hospital and a police report was made leading to Tambudzai’s arrest.
