A 32 year-old Kwekwe woman was lucky when a six months jail term was wholly suspended for 210 hours of community service for making a false maintenance claim in a bid to fix her ex-lover.
Siphathisiwe Dlamini (32)’s bid to “fix” her ex-lover backfired after she found herself before a Kwekwe magistrate for making a false maintenance report against Dumisani Ncube.
Dlamini of D42 Amaveni in Kwekwe, was arrested after it was discovered that she had lied in her maintenance claim against Ncube, a police officer based at Amaveni Police Station.
She was arraigned before Kwekwe magistrate Miss Vimbai Mtukwa who sentenced her to six months in prison which were wholly suspended on condition that she performs 210 hours of community service.
In mitigation, Dlamini, who pleaded guilty, told the court that the move was a way of revenging against Ncube who used her money before he dumped her for another woman.
“I am very sorry Your Worship for such actions. I did them without thinking about the implications as I wanted him to pay back the money I used on him when he fell sick,” she said.
Miss Mtukwa said Dlamini did not only waste Ncube’s time but also that of the court by making false allegations.
“Think of the time you wasted for the clerk of court, the time of the Government that you wasted. It’s very bad that women take advantage of such provisions to try and settle personal scores, you deserve a custodial sentence. However, taking the fact that you are a first offender, you will perform community service,” ruled the magistrate.
Allegations against Dlamini are that on 26 March 2019 she approached the Civil Court where she claimed $230 per month for the upkeep of her eight year old child.
However, upon being served with the summons, Ncube told the police officers that he never sired a child with Dlamini and investigations were instituted. The investigations revealed that the allegations were false and upon being quizzed, she confessed that she wanted to “fix” Ncube, leading to her arrest.
