A Zimbabwe Power Company (ZPC) boss, who is accused of sexual harassment, recently had his application for discharge dismissed by a Mbare magistrate.
Patrick Ndhlovu (52) who is a ZPC shift charge superintendent based at Harare Power Station had applied for discharge at the close of the State’s case.
He argued that the State had failed to prove a case against him.
In response, prosecutor Ms Yvonne Gurira argued that from the evidence the State had led, it was clear that Ndhlovu had a case to answer.
In her ruling, Ms Kudzai Zihove said the State had a prima facie case against Ndhlovu and he had to be put to his defence.
She deferred the matter to November 23 for trial continuation.
Ndhlovu is charged with indecent assault.
It is alleged that Ndhlovu, while in the boiler section, stealthily approached the woman from behind and grabbed her by the waist without her consent.
The court heard that when the woman asked him why he had acted in such a manner he responded by laughing.
It is the State’s case that the woman reported the matter to the police leading to Ndhlovu’s arrest.
