15 years in prison for man got sister (14) drunk and tried to rape her

A 26-YEAR-OLD Tsholotsho man was sentenced to effective 15 years in prison after he plied his 14-year-old younger sister with alcohol and tried to rape her.
The man was convicted of attempted rape by Bulawayo Regional magistrate Ms Sibonginkosi Mnkandla.
The accused person cannot be named to protect the identity of the victim.
In passing sentence Ms Mnkandla took into consideration that the offender pleaded not guilty to the charges levelled against him showing that he was not remorseful and wasted the court’s time. She noted that the State had led three witnesses against him. She said the offender was charged with attempted rape as it was proved that the penetration did not occur.
“What’s more surprising is that he fled the scene after he was confronted about it the following morning and was apprehended by villagers. The offender had claimed the rape was fabricated because of family grievances, the offender is accordingly found guilty of attempted rape, sentence of rape is applicable in this case,” Ms Mnkandla said.
The prosecutor Ms Nomthandazo Mafu said on July 29 around 6pm the offender returned home from a borehole carrying a Pepsi bottle filled with alcohol, he went to the kitchen where his sister was preparing supper and forcibly made her consume alcohol.
The court heard that the victim became intoxicated.
Ms Mafu told the court that they had dinner the offender left the house around 8pm, while the victim and her other siblings went to bed. He however returned home around midnight and carried his sister to his bedroom.
One of the witnesses, the victim’s sibling told the court that she saw the offender on top of the victim while they were both naked.

It was also revealed in court that the victim’s sibling witnessed the offender carrying his sister into his bedroom. This happened when the offender had given the witness his phone and asked her to take some blankets to the kitchen. When she returned, she found the offender on top of his sister, both naked. When she questioned him about what he was doing and the offender did not respond but simply covered himself with a blanket.
Ms Mafu said the victim who was drunk was fast asleep and did not see anything but was informed in the morning about what had befallen her.
