THE two men accused of attacking and threatening Madzibaba Moses (Lloyd Gwasira) will be back in court today for their bail application.
They first appeared at the Harare Magistrates’ Courts yesterday.
Tafadzwa Matoro and Elvis Borerwi were remanded in custody by magistrate Noticia Shenje on the first count of assault.
They denied assaulting Madzibaba Moses.
The State submitted that it intended making proper submissions to deny the two bail.
However, defence counsel, Kudakwashe Munyoro, submitted that the State was just being malicious in denying his clients’ bail.
The magistrate said she was not aware why the State was denying the duo bail and rolled over the matter to today.
“The court is overwhelmed today and it cannot attend to the bail application since I do not know why the State is opposing bail,” said magistrate Shenje.
Matoro is also being accused of pointing a firearm at Madzibaba Moses, threatening to kill him.
Magistrate Kudzai Miti, who is hearing the case, remanded Matoro to today for bail ruling.
It is alleged that on Tuesday, Madzibaba Moses was conducting prayer sessions with members of his Johanne Masowe eChishanu in Highfield, Southerton, Lochinvar, Kambuzuma and Warren Park.
The court heard that when Madzibaba Moses was in Warren Park 1, he was intercepted by Matoro, and they exchanged greetings and held a small discussion.
Maroto phoned his cousin, Elvis Borerwi, to come and meet Madzibaba Moses for talks.
The State said Matoro started shouting and insulting Madzibaba Moses, accusing him of being a witch and causing his downfall.
He also accused Madzibaba Moses of throwing goblins into Elvis Borerwi’s house in Warren Park.
The two confronted Madzibaba Moses, and Borerwi allegedly grabbed him and threatened to kill him.
The State said the two assaulted Madzibaba Moses, Matoro took out a CZ Vzor pistol, corked it and pointed it at him.
Madzibaba’s followers swiftly reacted and managed to disarm Matoro.
A report was made to the police leading to Matoro’s arrest.
The investigating officer, Lawrence Chademana, made oral submissions, and indicated that there’s a relationship between Matoro and Madzibaba Moses, as they come from the same rural village in Chirumhanzi.
“They have some issues which date back to 2019 and I think they have a grudge which they failed to resolve.
“It is the complainant’s fear that if released on bail, he might be attacked again,” said Chademana.
During cross examination Chademana said Madzibaba Moses once applied for a peace order against Matoro, but the defence counsel said the investigating officer could not show the court the peace order.
Defence counsel Mukangami told the court that Matoro was, in fact, the one who was assaulted by Madzibaba Moses’ congregants.
