Tanaka was found guilty and fired, while the NEC Appeals Board upheld his dismissal.
He appealed to the Labour Court disputing that he was the custodian of the missing cash and did not play any role in its handling.
Labour Court president Mr Godfrey Musariri noted from the evidence adduced, that Tanaka was indeed a custodian of the money on the day in question.
“Having established that, the disciplinary committee found that Tanaka was grossly negligent,” Mr Musariri said.
“He did not follow procedures in the handling of the said cash.”
From the filed evidence, Mr Musariri did not find fault in the disciplinary committee’s finding.
Evidence was adduced that Tanaka was holder of the relevant keys and had the user identity on the day in question.
Witnesses called by Tanaka testified that he was actually a custodian of cash the day it went missing.
It was not in dispute that Tanaka did not sign the dispatch entries confirming that he had checked and verified the cash in metal canisters.
It was also not in dispute that Tanaka did not seal the trunk with tamper proof seals, although it was locked.
