counts of rape when he appeared before Chitungwiza regional magistrate Ms Estere Chivasa.
He was however convicted of a competent verdict of aggravated indecent assault charges after prosecutor Ms Joice Fusire failed to prove a case of rape at the end of the trial.

The boy denied the allegations claiming to have been in love with the girl. The boy also told the court that he had failed to be intimate with the girl after being disturbed before the act.

In assessing the sentence, Ms Chivasa noted that the boy was disrespectful by fondling the girl’s breasts in her parent’s house. She said that it was very disturbing to learn that the two parties were assaulted by police officers. She said this could have forced the teenagers to admit having had sexual intercourse.
