Couple fights at court

THERE was drama outside the Mutare Civil Courts on Monday when a couple fought over the custody of their three-year-old child.

Jenifer Mutsera could not stomach being dragged to the courts over the custody of her child by her husband, Sam Chibaya, as she attacked him outside the court premises.

She hurled insults at him, accusing him of being wicked and conspiring to give her child to another woman.

In a fit of rage, she grabbed his denim trousers and shouted on top of her voice saying it was better to be arrested than give up her child so easily.

Members of the public quickly intervened and stopped the brawl.

The two had appeared before Mutare magistrate Mrs Sharon Chipanga over the custody of the child.

Chibaya told the court that he was still married to Mutsera but they were no longer staying together. He accused her of stealing his child and placed him in the custody of her mother in the rural areas in Odzi.

“Your Worship, this woman asked if we could send our child to her mother, but little did I know that it was the final goodbye. She then ran away to South Africa and I could not get my child back because her mother refused to release him. I am applying for the custody of the child because she is a bad mother. My child is on medication and thus he needs special care, which I can provide,” he said.

In her defence, Mutsera said she went to South Africa after she had been assaulted.

“I ran away to South Africa after I had been assaulted over the child who had spent a month at my mother’s place.

“I cannot watch my child being taken away from me because I am still able-bodied and can work to look after him,” said Mutsera

The court will rule on January 23.
