Court dismisses application

THE Harare Civil Court threw out an application for a protection order by a city woman, who accused her husband of physical abuse.

Mitchel Payne approached the court seeking a protection order against her husband only identified as Tembo in court papers.

She accused him of stealing her undergarments and ritual linen.

She also alleged that Tembo had been stalking her.

“He should stop following me around and he must return my undergarments and ritual stuff.

“Sometime last year, he assaulted me using a baseball bat.

“He felt bad and bought a phone for me.

“He went through my wallet and stole my condoms and cellphone,” Mitchel said.

In response, Tembo denied the allegations. “The reason she applied for a protection order is just that she is trying to cover up her cheating ways.

“We had an argument the day she claimed I stole her things after she said the relationship was no longer working for her.

“On the 23th of August, I caught my wife cheating.

“The following morning she was very nice and I was suspicious so I searched her bag and found condoms and a cellphone that I didn’t know of,” Tembo said.

Magistrate Rutendo Machingura dismissed the protection order application for failing to present convincing evidence.
