adminChristian Faydserbe (47) a Mauritian national appeared before Chiredzi magistrate Mr Langton Ndokera facing charges of occupying gazetted land without lawful authority according to the Gazetted Land Consequential Provisions Act. He was found guilty of the offence. Faydserbe had, through his lawyer, Mr Rodney Saratoga Makausi of Chihambakwe, Makonese and Ncube submitted that his farm was exempted from acquisition as it was protected under a Bilateral and Investment Promotion Agreement between Zimbabwe and Mauritius. However, Mr Ndokera agreed with the State that the BIPPA was not a lawful authority as Faydserbe was supposed to get an offer letter, lease agreement or permit from the Minister of Lands, land reform and Resettlement.
