Drunken wife sets a?marital rape trapa

An estranged wife with cruel intentions has been accused of trying to trap her husband into sleeping with her so she can cry marital rape.

Sifiso Hungwe is reported to have tried to force her husband, Bongani Nyathi, to have sex with her with the intention of later reporting him for rape, while she maintained that if her husband did not want her anymore, he should divorce her a?the proper waya?.

a?I have been married to Bongani Nyathi since 2004. We have two children together. Bongani is in the habit of chasing me out of the house saying he is no longer interested in me. He is also threatening to kill me if I refuse to take heed of his eviction orders. My prayer is that if he no longer wants me as his wife he should follow the right procedure rather than chucking me out of the house because by doing so he is disturbing my peace,a? said Hungwe at the Bulawayo Civil Court where she had dragged Nyathi seeking a protection order.

However, tables turned when Nyathi gave his side of the story.

a?All that she said is not true. I am not a violent person. I have never threatened her with death in any way. She is the one who is abusing me. She is always stalking me and provoking me.

a?She is always coming home drunk and forcing me to have sexual intercourse with her, so that after the act she can report me to the police for marital rape. The reason why she wants to have me arrested is that she wants to take over my house upon my condemnation to prison.

a?We are sleeping in separate bedrooms and I am surprised with her claims that I am chucking her out of the house yet she is the one who is using the main bedroom,a? he said.

In his ruling, presiding magistrate Tawanda Muchemwa however, dismissed Hungweas application saying she did not dispute her husbandas claims that she was the one who was abusing him.
