A FORMER Highlanders player was yesterday dragged to the Maintenance Court by his estranged wife, a former Bulawayo model, who wants his salary garnished.Siduduzile Phakathi applied for Bruce Tshuma’s salary to be garnished saying he has been failing to abide by a $100 monthly maintenance order previously imposed on him.
She said that the ex-Bosso player was in $400 arrears.
Tshuma told magistrate Sheunesu Matova that he defaulted because he is unemployed.
He said his contract with Highlanders was terminated last year in December.
“Your Worship, the reason why I’ve been failing to pay is because I’m unemployed.
“I’m asking you to give me two to three months to clear the debt because I’m expecting to get a contract soon,” Tshuma said.
Magistrate Matova dismissed the garnishee application saying he can only order a salary to be garnished if a person is formally employed.
The magistrate, however, ordered Tshuma to keep on paying the maintenance and said the arrears must be cleared by January, 31, next year.
“Mr Tshuma, you’ve to comply with court orders. You shouldn’t have stayed at home while you knew you have a maintenance amount to pay. It is also your right to come to court and apply for a variation downward if you can no longer afford to pay the amount,” said Matova.
Recently, Tshuma tried to get a contract with How Mine but things did not go in his favour.
In August this year, Tshuma and Phakathi who separated in 2013 were reported to have rekindled their love before yesterday’s appearance in court over the upkeep of their son.
