A RUSAPE man who made false claims of being in an intimate relationship with his friend’s wife during a heated exchange of words was fined for the wild claims.
Tapiwa Mututu was dragged to Chief Makoni’s community court recently by a fellow vendor, Takudza Faramenga, accusing him of being intimate with his wife, Faith Mwandini.
Faramenga stated that Mututu told him that he was in a relationship with Faith, and wanted to be compensated with a beast.
“On December 19, 2024, Mututu urinated on my car which was parked in the Central Business District. I questioned the motive behind his move. He said there was nothing special about the car, and I do not have anything since the car belonged to my sister. He said I am a man of no means.
“I also fired back, saying he once made a lot of money sometime back, bought a house which he later sold, and we are now at the same level, doing the same hustling. Mututu then said he had slept with my wife. He added that my wife always winks at him.
“I remained calm and went home where I confronted my wife, who denied ever sleeping with Mututu. The following morning my wife confronted Mututu, who begged for forgiveness, saying he was drunk when he made the claims. I told him that the issue requires to be resolved in a court. I want him to pay me one beast for sleeping with my wife. On December 21, 2024, Mututu begged for forgiveness and I recorded him. He offered to compensate me for what he had said,” narrated Faramenga.
Faith denied ever being in a relationship with Mututu, and said he approached her begging for forgiveness for the false claims.
“I neither had a relationship with Mututu nor slept with him. When I confronted him, he begged for forgiveness. He claimed that he was drunk when he uttered those claims,” said Faith.
Mututu told the court that there is bad blood between him and Faramenga, which has strained their friendship.
He flatly denied ever claiming sleeping with Faith, and in turn claimed Faramenga was the one who accused his wife of being loose.
“I never uttered those words. Faramenga just suspected that I urinated on his car because that is where he urinates when drinking beer. We were actually drinking beer together. He said I have juju which I wanted to splash on his car.
I reminded Faramenga that it was me who had allocated him the place to sale his stuff after other people refused to accommodate him. We were friends, but he later became jealousy as I was making more sales than him.
“He started selling the same stuff as mine and our friendship grew apart. We stopped drinking together. He said I have juju, and my wife is a prostitute, and I became angry.
“I responded saying if my wife is of loose morals, so it means we are all married to prostitutes. I never said I slept with his wife. I will not make such dangerous claims. I don’t even know the name of his wife, but we just greet each other,” said Mututu.
Faramenga’s mother, Emilia Faramenga told the court that Mututu just made wild claims to piss off his son, who was competing with him in business.
“Mututu did not sleep with my daughter-in-law. When I heard about the issue I confronted, and quizzed him on why he would say such things that tarnish Faith’s image.
“He actually wanted to meet Faith’s relatives to beg for forgiveness, but later reneged. Mututu is jealousy of my son’s progress, and he wants to disturb his marriage,” she said.
The court found Mututu guilty of verbal insult and uttering vulgar words.
He was fined three goats as well as Faramenga’s costs of the lawsuit.
“Mututu did not sleep with Faith. He made the wild claims while insulting Faramenga. You insulted a person who was not part of the dispute. He made a serious claim which could have led Faramenga to assault and injure his wife and cause domestic violence.
“Mututu uttered rotten words in public. He is guilty of verbal insult. He will pay Mututu two goats, US$45 cost of the lawsuit and one goat fine. He has two months to pay,” ruled the court.
