The 40-YEAR-OLD man who was taken to court by the wife of former Public Works Deputy Minister and non-constituency Senator Guy Georgias on allegations of theft and malicious damage of property has been acquitted. Kuda Nyambo was taken to court by Mrs Georgias after it was alleged that he vandalised and stole some of her property at her Glen Lorne house.
Nyambo was found not guilty of the charges by Harare magistrate Ms Rekina Dzikiti.
Ms Dzikiti said the State had failed to prove its case against Nyambo.
“Therefore, there is no concrete evidence that links you to the charges you are facing,” she said.
“There is no evidence that shows you were present at the time when the property was vandal- ised.”
Circumstances are that between December last year and August this year, Mrs Georgias and Nyambo entered into a memorandum of agreement to lease her property for US$3 000 per month.
The court heard that Nyambo begged Mrs Georgias to allow him to occupy the property before the agreed dates and she agreed after he paid US$6 000.
The money was for rentals for December last year and January this year.
It is alleged that Nyambo occupied the house while it was in a good condition, but failed to pay rentals for the following months which was in breach of the agreement.
The court heard that Mrs Georgias made efforts to get rentals from Nyambo but to no avail.
The State alleged that Nyambo employed security guards at the house whom he instructed to bar Mrs Georgias from entering the premises.
He was alleged to have stayed at the house for seven months without paying rentals.
Mrs Georgias informed Nyambo that she was going to take legal action against him if he failed to make payments and Nyambo vacated the property the next day without informing her.
The court heard that he left the keys to the house with a security guard who later called Mrs Georgias threatening to leave her property unattended if she failed to collect them.
Mrs Georgias brought two police officers to inspect the house and realised that it was in a deplorable state.
The court was told that several items had been damaged, including a council water meter and electricity cables.
